If something on Linktain infringes your copyright, this is how to get it taken down and what happens after you ask.
1What Linktain hosts
Creators use Linktain to put a destination behind a gate. Sometimes that destination is a file they uploaded to us; more often it is a link to somewhere else. We do not review either before it goes live. We act on reports.
2Reporting infringement
Send a notice to info@linktain.com with DMCA in the subject line. Every locked page also carries a Report this link control at the bottom, which reaches the same queue and pre-fills which link you are reporting.
3What a notice must contain
Identify the copyrighted work you own. Identify the Linktain link or file you say infringes it, by full URL. Give us your name, address and email. State that you believe in good faith the use is not authorised by the owner, its agent, or the law. State that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorised to act for them. Sign it, physically or electronically.
4What we do with it
A valid notice gets the link disabled, usually the same day. We tell the creator what was disabled and who complained, because they are entitled to answer it. Nothing is deleted; a disabled link stops serving and stops earning.
5Counter-notice
If your link was disabled and you believe that was a mistake or a misidentification, reply to the notice we sent you. Include the link, a statement under penalty of perjury that you believe it was removed by mistake, your contact details, and your consent to the jurisdiction of the courts where you live. We may restore the link if the complainant does not file suit.
6Repeat infringers
Accounts that collect repeated valid notices are terminated. This is not discretionary and it is not a warning system with a fixed number of strikes: a creator uploading other people's paid content is not running the same business as one who got a single disputed claim.
7Safe harbour
Linktain is a United States service provider and follows the notice-and-takedown process in 17 U.S.C. 512. We act expeditiously on valid notices, we do not receive a financial benefit from infringing activity we control, and we terminate repeat infringers.
8False claims
Filing a notice you know to be false has legal consequences for you, not for us. Read section 512(f) before sending one about a competitor.
